1. About these terms

These Terms of Service govern your use of the Transfer Guardian website and services, provided by Poseidon Finance Pty Ltd (ABN 93 686 108 707) trading as Transfer Guardian ("we", "us", "our"). By using our website, registering an account or submitting a verification, you agree to these terms and our Privacy Policy.

2. Our services

Transfer Guardian provides bank account verification services. We check that a receiving account belongs to the intended recipient and issue verification certificates and verified payment links.

Transfer Guardian does not hold, transmit or remit client funds. Payments are made through your own bank or our payment network provider. International and foreign exchange transfers are provided by our licensed FX provider under its own terms and conditions.

3. Your obligations

• You must provide information that is true, accurate, current and complete, and must not impersonate any person or entity.
• You must only submit documents and details you are authorised to provide.
• You must keep your account login details secure and notify us promptly of any unauthorised use.
• You must not use our services for any unlawful purpose, including fraud, money laundering, terrorism financing or sanctions evasion.

4. AML/CTF and our right to refuse

We conduct customer identification, verification and screening, including sanctions and politically exposed person checks, consistent with Australian AML/CTF laws. We may request further information or documents at any time.

We may refuse, suspend or revoke a verification, or close an account, if we cannot satisfactorily verify information, if we suspect unlawful activity, or where required by law. We may be legally prohibited from telling you the reason.

5. Verification is not a guarantee

Verification significantly reduces, but cannot entirely eliminate, the risk of fraud. A verification reflects the information available to us at the time it was performed. You remain responsible for confirming payment instructions and exercising your own judgement before transferring funds. Our services do not constitute financial, legal or investment advice.

6. Fees

Fees for our services are displayed on our website or agreed with you before the service is provided. Fees are payable in advance unless otherwise agreed and, except where required by law, are non-refundable once a verification has commenced.

7. Liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, our liability for any loss arising from our services is limited, at our option, to re-supplying the services or refunding the fees you paid for the relevant service.

To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss caused by the acts or omissions of banks, payment providers, FX providers or other third parties.

8. Intellectual property

The Transfer Guardian name, logo, website content and verification technology are owned by or licensed to Poseidon Finance Pty Ltd. Our verification process is the subject of Australian Patent No. 2025903789. You must not copy, reproduce or reverse-engineer any part of our services without written consent.

9. Complaints and disputes

If you have a complaint, please contact us at [email protected] or 08 6263 6236. We will acknowledge your complaint promptly and aim to resolve it within 30 days.

Our membership of the Australian Financial Complaints Authority (AFCA) is pending. Once membership is confirmed, if you are not satisfied with our response you may refer your complaint to AFCA, a free and independent external dispute resolution scheme.

10. Changes and termination

We may update these terms from time to time by publishing the updated version on this page. We may suspend or terminate your access to our services if you breach these terms.

11. Governing law

These terms are governed by the laws of Western Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
